Terms of Service

The agreement between you and Freistil ApS when you use clowdr.dev.

Effective: 1 September 2026

Welcome to clowdr.dev, a membership-based community where indie developers ship real games together. clowdr.dev is operated by Freistil ApS, Åvej 9, 6510 Gram, Denmark (CVR 45808491). By creating an account, joining as a Clowdr Dev, or contributing to any clowdr.dev project, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use clowdr.dev.

1.Membership & Billing

  • clowdr.dev offers a single membership tier: Clowdr Dev. Every member joins on the same terms — leading a project is an activity, not a separate tier. The current price, billing interval, and any applicable taxes are shown on the checkout page before you confirm your subscription.
  • Your membership renews automatically each month until you cancel. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period.
  • Membership gives you access to the platform, Discord community, project boards, and the playbook. Access is granted for personal, non-transferable use only.

2.Payments & Refunds

  • Payments are processed by our payment providers. By subscribing, you authorise recurring charges to your chosen payment method.
  • As a consumer in the EU, you have a statutory 14-day right of withdrawal on your first membership payment. To exercise this right, email contact@clowdr.dev within 14 days of your initial charge and we will refund it in full.
  • After the 14-day withdrawal window, payments already made are non-refundable, but you can cancel future billing at any time. No partial refunds are issued for unused portions of a billing period unless required by law.

3.Account Responsibility

  • You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
  • Accounts are personal. Please do not share your account with others or transfer it without our written consent.
  • We may suspend or terminate accounts that violate these Terms, the community guidelines, or applicable law. Where feasible, we will give notice and an opportunity to cure.

4.Your Contributions & License to clowdr.dev

You retain full ownership of any original content you create and contribute to a clowdr.dev project — code, art, music, audio, writing, design, documentation, or anything else (your "Contributions"). clowdr.dev does not claim authorship of your work.

  • By submitting a Contribution to any clowdr.dev project, you grant Freistil ApS a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display the Contribution (a) as part of the clowdr.dev project you contributed it to, including publication and distribution of the integrated game, (b) in other clowdr.dev projects and shared frameworks, and (c) in marketing materials about clowdr.dev and its projects (including screenshots, trailers, social media, case studies, and press).
  • This license is non-exclusive: you keep every right to use, license, or sell your own Contributions as you see fit.
  • This license is non-revocable: once granted, it cannot be withdrawn, even if you end your membership or a project ends. This is the only way we can safely reuse shared assets across projects and show finished games in marketing.
  • Wherever reasonably practical, we will provide attribution by name (or your chosen alias) when we reuse a Contribution. Attribution may appear in game credits, project READMEs, asset metadata, or marketing captions, as appropriate to the medium.
  • You represent that each Contribution is your original work or that you have the rights necessary to grant the license above, and that your Contribution does not infringe any third party's rights.

5.Projects, Publication & Independent Releases

  • Each clowdr.dev project is stewarded by a project lead who sets scope, reviews Contributions, and submits the finished project for Publication Review. Whether the game is published under the Clowdr brand is decided by Clowdr (Freistil ApS), not by the project lead.
  • Clowdr publishes accepted projects under the Clowdr brand after a successful Publication Review. A review may also end in Revision Required (correctable blockers are named and the project stays on the Clowdr publication path) or Publication Declined (Clowdr's final decision not to publish the project under its brand).
  • A release of the full collaborative project outside the Clowdr brand (an Independent Release) is permitted only after both Publication Declined and an explicit written Independent Release Authorization together with a project-specific sublicense from Freistil ApS. Independent-release permission is never implied by silence, delay, Revision Required, membership changes, or an incomplete review.
  • Contributors keep ownership of their own Contributions, may use them freely outside the project, and may showcase the shipped game in their portfolio. Credits, attributions, disclosures, and licenses already granted remain intact in every publication path.

6.Community Standards

clowdr.dev is a community of makers. When you participate, you agree to:

  • Treat other members with respect and good faith.
  • Keep contributions constructive, on-topic, and appropriate for a mixed professional audience.
  • Refrain from harassment, hate speech, spam, doxxing, or any unlawful behaviour.
  • Respect copyright, trademarks, and other intellectual property rights.
  • Follow the additional rules posted in Discord and on individual project pages.

7.Tools & Data

To run clowdr.dev we use third-party tools for payments, authentication, analytics, and communication (for example Discord and our payment processor). How we collect, use, and protect personal data is described in our Privacy Policy, which forms part of these Terms.

8.Disclaimers & Limitation of Liability

  • clowdr.dev is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, defect-free operation, or that any project will ship on a specific timeline.
  • To the extent permitted by Danish law, Freistil ApS's total liability to you for any claim arising from these Terms or your use of clowdr.dev is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.
  • Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for gross negligence, wilful misconduct, or mandatory consumer rights.

9.Governing Law & Disputes

These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence remain unaffected.

Disputes will be handled by the competent courts of Denmark, unless mandatory law gives you the right to sue in your own country. We are not obliged and not willing to participate in alternative consumer dispute resolution procedures.

10.Changes to These Terms

We may update these Terms to reflect changes to the service, our legal obligations, or our business. We will update the effective date above and, for material changes, notify active members by email or in-product notice at least 14 days before the change takes effect. Continued use of clowdr.dev after the change takes effect means you accept the updated Terms.
